Your Questions About Doing Business Online Government

Mary asks…
How do u copyright a online business name?
I have an online business and I would like to know how do I copyright/patent the website and business name with the government to protect myself from copyright infringment, etc. If it is useful I information I am based out of NY.

Jere answers:
You wouldn’t copyright it. Copyrights can be obtained for things of an artistic nature. This includes, of course, poetry, films, sculptures, music, fiction, etc. But can also include things that may not necessarily seem “artistic” in the general sense of the word. Copyrights can also be obtained for advertising copy, games, software programs and blueprints, to name just a few.
To protect a business name within your industry, you would apply for a trademark.
Trademarks can be names of products or services, logos, slogans, packaging and even sounds and smells. In essence, a trademark can be almost anything that is used to identify a particular product or service. Registering a trademark grants the owner exclusive rights to the mark within the specified industry.
Of course, it’s necessary to research the mark comprehensively prior to filing to ensure that there is no possibility of infringing upon another party.
This entails searching the pending & registered Federal and State trademark files as well as the US National Common-Law files. Then, if clear, you can decide if you would like to file for a Federal or a State trademark.
To register a trademark, that’s done either through your Secretary of State for a State trademark or the US Patent & Trademark Office for a Federal trademark.
If you are only conducting business in one state, then a State trademark is most appropriate. If you conduct (OR are planning to conduct) business in at least 2 states OR between the US & any other country, you can file for a Federal trademark.
Hope that helps! I wish you much success & happiness in all your ventures!

Michael asks…
if the government investigates your business can they question your customers?
Question:
If you own a business doing online sales, and all of your customers are completely happy with your products and none of them have filed any complaints or claims, they love your company very very much, but the only problem is the federal or state government doesn’t like the way your company is being ran so they decide to investigate.
OK this is the question:
if the government investigates your business can they question your customers and use the evidence against you in court in the form of your customers doing a physical testimony or writing a statement ?
and when you give the answer could you please show some legal documents to prove this like state law or amendments

Jere answers:
Can the US government, to whom we pay taxes and seek security, investigate our business
operations and interview our customers? WHY not? Investigation work is investigating.
IF you have done nothing unethical, immoral or illegal, what is your concern?
Investigators are permitted to seek evidence ANYWHERE……….

Linda asks…
Do you know any woman who really have gotten Government Grants for her business? Too many scams online!?
I am a woman, business owner. Looking for funds for my new business. A lot of thing already done, but without means I cannot hire right people to help me and there is no way to advertise aggressively.
All grant ads online offer 7 day trial , after that $39.95 site membership fees. Maybe free money for women-business owner do not exist at all?
Any advise will be greatly appreciated!
Thanks in advance.

Jere answers:
Lots of SCAMS — You may want to read the warnings FTC has issued against these “grant” companies:
http://www.ftc.gov/opa/2004/03/grantresources.htm
http://www.ftc.gov/bcp/edu/pubs/consumer/alerts/alt134.htm
Here is also one of the warnings issued by the Better Business Bureau http://www.concord.bbb.org/tips_timesharescams.html
It is hard to find grants to start a business. Unlike the myths that some perpetuate, federal government and even private foundations hardly give grant money for starting a for-profit business.
One possible exception is for companies developing or exporting agricultural goods, including food and forest product. Another exception could be the Small Business Innovation Research (SBIR) or Small Business Technology Transfer (STTR) programs http://www.sba.gov/aboutsba/sbaprograms/sbir/index.html , which fund the research and development of technological innovation that meets specific government needs.
Your best bet actually will be from the states if they offer grant programs for women (or any other special interest groups — minorities, women, disabled, veterans, etc). Or check with non profit organizations, particularly women organizations if they offer grants. Examples include
Iowa Women’s Foundation http://www.iawf.org/
New Mexico Women’s Foundation http://www.nmwf.org/guidelines.html
Even SBA does NOT give out grants. From the SBA website http://www.sba.gov/mostrequesteditems/CON_FAQ2.html
“The U.S. Small Business Administration does not offer grants to start or expand small businesses, although it does offer a wide variety of loan programs. (See http://www.sba.gov/financing for more information) While SBA does offer some grant programs, these are generally designed to expand and enhance organizations that provide small business management, technical, or financial assistance. These grants generally support non-profit organizations, intermediary lending institutions, and state and local governments.”
Nonetheless, you can go to the Catalog of Federal Domestic Assistance (CFDA) http://www.cfda.gov and Grants.gov http://www.grants.gov – these are two sites created by the federal government to provide transparency and information on grants. Browse through the listings and see if you can find any grant that would support a for-profit venture.
Most of the federal grants are given to specific target groups with specific requirements (e.g. Minority business owners involved in transportation related contracts emanating from DOT – Grant#20.905 Disadvantaged Business Enterprises Short Term Lending Program
Grants are also often given to non profit groups or organizations involved in training or other similar activities (grant 59.043 Women’s Business Ownership Assistance that are given to those who will create women’s business center that will train women entrepreneurs

Donna asks…
i am looking to start an online business, i have all of my ideas but i know that taxes will be an issue, help!?
how can you start an online business and make money while still doing things according to the tax laws. i know nothing about taxes and i really want to get this business started but i dont want to end up getting in trouble with the government because i owe tax money from the income that i will make from my business. can someone help me out?

Jere answers:
You can apply for a tax id # for your business online or set up a dba (Doing Business As) account at your bank. Keep a separate account and put 20% of all your earnings in that account. DO NOT TOUCH THAT MONEY!!! Keep all your receipts for purchases pertaining to your business ect. An accountant can help you with all the details.
